determinata nell\u2019ammontare e non sottoposta a termine o condizione) da una persona o da un\u2019azienda stabilita in un Paese dell\u2019Unione Europea (ad eccezione della Danimarca) diverso dal proprio. Pu\u00f2 accadere infatti, nel caso in cui si debba recuperare del denaro nei confronti di un soggetto stabilito in un Paese diverso dal proprio, di lasciarsi scoraggiare dalla prospettiva di non trascurabili difficolt\u00e0, costi eccessivi e dispendio di tempo, timori che troppo frequentemente inducono a rinunciare a far valere i propri diritti. Le informazioni sulle lingue accettate dall\u2019organo giudiziario competente possono essere richieste direttamente al relativo ufficio giudiziario.<\/p><p>L\u2019ufficio giudiziario competente, ricevuta la domanda, pu\u00f2 chiedere alla parte di completare o rettificare la stessa attraverso la compilazione del\u00a0<strong>modulo B<\/strong>, fissando altres\u00ec un termine entro il quale il richiedente\/ricorrente deve procedere con le modifiche o le integrazioni.\u00a0<\/p><p>Se a seguito dell\u2019eventuale rettifica, il giudice non pu\u00f2 accogliere la domanda cos\u00ec come formulata dalla parte richiedente, sottopone a quest\u2019ultimo una proposta di modifica della domanda attraverso l\u2019apposito\u00a0<strong>modulo C;\u00a0<\/strong>entro un determinato termine, fissato dallo stesso giudice, il richiedente \u00e8 invitato ad accettare o rifiutare la proposta di ingiunzione di pagamento relativa all\u2019ammontare fissato dall\u2019autorit\u00e0 giurisdizionale.\u00a0<\/p><p>Se il richiedente accetta la proposta del giudice, quest\u2019ultimo emette l\u2019ingiunzione di pagamento europeo per la parte della domanda accettata. Se, invece, il richiedente non invia alcuna risposta entro i termini fissati o rifiuta la proposta del giudice, la domanda di ingiunzione viene respinta nella sua interezza.\u00a0 La richiesta di ingiunzione di pagamento \u00e8, inoltre, rigettata se il credito risulta manifestamente infondato o non sono soddisfatte le condizioni espressamente richieste dal regolamento; la domanda \u00e8 formalmente respinta attraverso il\u00a0<strong>modulo D,\u00a0<\/strong>nel quale vengono esplicitate le cause del rigetto e contro cui non \u00e8 possibile proporre impugnazione. \u00c8 in ogni caso possibile, a seguito di rigetto, avviare un procedimento civile ordinario oppure presentare una nuova domanda di ingiunzione di pagamento europea.<\/p><p>Se invece la domanda \u00e8 stata correttamente presentata o adeguatamente modificata\/rettificata, il giudice emette l\u2019ingiunzione di pagamento europea, di norma entro 30 giorni dalla domanda, attraverso la compilazione del\u00a0<strong>modulo E.<\/strong><\/p><p><strong>\u00a0<\/strong><\/p><p>Il convenuto (soggetto contro il quale \u00e8 presentata la domanda) \u00e8 informato, attraverso opportuna notifica, della possibilit\u00e0 di pagare il credito richiesto dal ricorrente oppure di presentare, entro 30 giorni, opposizione all\u2019ingiunzione di pagamento.
