It is a key protection for consumers across the European Union, designed to make cross-border shopping safer and easier. This right lets you return a product and get a refund\u2014without needing to give a reason or pay any penalty\u2014when you buy online or sign contracts away from business premises. Here\u2019s how it works:<\/p><ul><li><strong>14 days to change your mind:<\/strong><\/li><\/ul><p>You have 14 days to withdraw from a purchase starting from:<\/p><p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 o The day the goods are delivered (for products), or<\/p><p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 o The day the contract is signed (for services).<\/p><p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 o If you order multiple items in one purchase, the withdrawal period starts when the last item is\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 delivered.<\/p><ul><li><strong>Extended period if information is missing:<\/strong><\/li><\/ul><p>If the seller fails to inform you about your right of withdrawal, the withdrawal period extends to 12 months. Once the seller provides the required information, you have 14 days from that date to exercise your right.<\/p><ul><li><strong>Special rules for doorstep sales and promotional trips:<\/strong><\/li><\/ul><p>For contracts signed during unsolicited home visits or promotional excursions, the withdrawal period is 30 days.<\/p><ul><li><strong>Digital content:<\/strong><\/li><\/ul><p>The right of withdrawal also applies to contracts for digital content (e.g., downloads or streaming) not supplied on a physical medium. However, this right expires if the download or streaming starts immediately, provided you have given explicit consent and agreed to waive your right of withdrawal. Choose a communication method that provides proof of when the withdrawal notice was sent. Sellers must acknowledge electronic withdrawal notices.<\/p><p>The seller is legally obliged to refund your payment within 14 days after receiving your notice of withdrawal, but they may wait until the goods are returned or proof of return is provided.<\/p><p>You must return the product within 14 days of notifying the seller. Inspecting the item is allowed, but if the product\u2019s value is diminished due to handling beyond what\u2019s necessary to check its function, the refund may be reduced.<\/p><p><strong>Who Pays for Return Shipping?<\/strong><\/p><p>By law, return shipping costs are typically your responsibility unless the seller\u2019s terms say otherwise. legale (artt. 128 -135-septies del Codice del Consumo),\u00a0il consumatore ha diritto a ricevere un bene conforme al contratto, ovvero un bene che soddisfi determinati requisiti soggettivi ed oggettivi fissati dalla legge rispetto ai quali ai quali vige la garanzia di 24 mesi dalla data di consegna che pu\u00f2 essere ridotta a 12 mesi nel caso di acquisto di beni usati.<\/strong><\/p>\n<p>In caso di difformit\u00e0 delle caratteristiche e prestazioni rispetto alle informazioni ricevute, in caso di un difetto di funzionamento o guasto del bene, in caso di mancata fornitura degli aggiornamenti contrattualmente previsti, si ha diritto alla\u00a0<strong>RIPARAZIONE<\/strong>,\u00a0<strong>SOSTITUZIONE<\/strong>\u00a0(a scelta del consumatore) e, qualora ci\u00f2 sia impossibile, eccessivamente oneroso o il venditore non vi provveda, anche alla\u00a0<strong>RESTITUZIONE DEL PREZZO<\/strong>\u00a0pagato o alla\u00a0<strong>RIDUZIONE<\/strong>\u00a0per difetti di lieve entit\u00e0.<\/p>\n<p>La legge pone a carico del solo venditore l\u2019obbligo di esperire i rimedi atti al ripristino della conformit\u00e0 del bene risultato difettoso; questo vuol dire che possiamo rivolgerci al negozio o al sito web da cui abbiamo acquistato il bene e pretendere che il venditore si occupi con la massima solerzia del nostro problema.<\/p>\n<p><strong>\u00c8\u00a0necessario, invero, tener distinta dalla garanzia legale la garanzia \u201cconvenzionale\u201d che pu\u00f2 essere offerta dal produttore, dal venditore stesso o da un terzo (compagnia di assicurazione per esempio) e che non sostituisce ma si somma a quella che per legge deve essere prestata dal venditore. Ignoriamo, dunque, i cartelli che recitano: \u201cil prodotto si sostituisce solamente entro XXX giorni dall\u2019acquisto, dopo ci si deve rivolgere ai centri di assistenza della casa produttrice\u201d e contestiamo l\u2019assunto del venditore che \u00e8 necessario rivolgersi al produttore: \u00e8 il venditore che deve riprendere a proprie spese il bene in restituzione e attivarsi, salvo poi rivalersi sul soggetto responsabile del difetto.<\/strong><\/p>\n<p>\u00c8\u00a0di fondamentale importanza richiedere e conservare lo scontrino fiscale o documento equivalente che attesta luogo e data di acquisto in quanto spetta al consumatore dimostrare che l\u2019acquisto \u00e8 stato effettuato presso quello specifico negozio, online o fisico, e che non sono ancora trascorsi 24 mesi dalla consegna. Tuttavia, \u00e8 utile spedire altres\u00ec il tagliando di garanzia o, comunque, effettuare tutti quegli adempimenti richiesti per attivare la garanzia convenzionale, se prevista per beneficiare eventualmente di tutele superiori rispetto a quelle previste per legge come, ad esempio, una durata maggiore o la copertura di danni accidentali o guasti dovuti all\u2019 usura.<\/p>\n<p>La nuove disciplina sulla garanzia legale di conformit\u00e0 si applica anche ai\u00a0<strong>beni con elementi digitali<\/strong>\u00a0ovvero \u201cbeni mobili materiali che incorporano, o sono interconnessi con, un contenuto digitale o un servizio digitale in modo tale che la mancanza di detto contenuto digitale o servizio digitale impedirebbe lo svolgimento delle funzioni proprie del bene\u201d. Si tratta pertanto di beni rientranti nel pi\u00f9 ampio ambito dell\u2019Internet of things (IOT), materiali che sono tuttavia connessi alla rete e con essa scambiano informazioni.\u00a0 Il venditore \u00e8 responsabile di ogni difetto di conformit\u00e0 del contenuto o servizio digitale che si verifica o manifesta entro 24 mesi dalla consegna o per un periodo pi\u00f9 lungo nel caso in cui la fornitura \u00e8 contrattualmente previsto per pi\u00f9 di due anni. Il venditore non sar\u00e0 responsabile del difetto che si manifesti a causa della mancata installazione dell\u2019aggiornamento a condizione che lo stesso abbia informato il consumatore della disponibilit\u00e0 dell\u2019aggiornamento, delle conseguenza in caso di mancata installazione ed abbia fornito adeguate istruzioni per l\u2019installazione.\u00a0\u00a0<\/p>\n<p><strong>Come provare l\u2019esistenza del difetto di conformit\u00e0?<\/strong><\/p>\n<p>L\u2019indicazione di caratteristiche e requisiti atti ad identificare la conformit\u00e0 del bene al contratto di vendita di fatto facilita il consumatore nel rilevare eventuali difetti come:<\/p>\n<ul>\n<li>il possesso delle caratteristiche e delle funzionalit\u00e0 previste contrattualmente<\/li>\n<li>la fornitura degli accessori, delle istruzioni per l\u2019installazione e la disponibilit\u00e0 degli aggiornamenti<\/li>\n<li>l\u2019oggettiva inidoneit\u00e0 del bene al normale uso, garantito da altri beni dello stesso tipo<\/li>\n<li>la mancanza di qualit\u00e0 e prestazioni abituali, in relazione a beni dello stesso tipo<\/li>\n<li>l\u2019errata installazione se effettuata sotto la responsabilit\u00e0 del venditore o dipende da istruzioni carenti<\/li>\n<li>una particolare condotta tenuta dal venditore nei confronti del consumatore prima della vendita (promesse e dichiarazioni verbali tese a convincere l\u2019acquirente)<\/li>\n<li>le ragionevoli aspettative che il compratore abbia portato a conoscenza del venditore al momento dell\u2019acquisto (in relazione all\u2019idoneit\u00e0 del bene all\u2019uso particolare indicato come esigenza dal consumatore)<\/li>\n<li>le qualit\u00e0 del bene presentato come campione e come modello parte integrante del contratto di vendita (questo si applica anche per le vendite a distanza).<\/li>\n<\/ul>\n<p>Va precisato, infine, che se il difetto si verifica o manifesta entro il primo anno d\u2019acquisto, si presume che il bene fosse non conforme sin dal momento della consegna salvo che la natura del bene o del difetto escluda tale presunzione. In Italia il rimborso viene solitamente erogato entro 60 giorni dalla presentazione della domanda, opportunamente documentata.<\/p>\n<p>\u00c8 buona regola, quando si viaggia, portare sempre con s\u00e9 la tessera europea di assicurazione malattia (TEAM), solitamente rilasciata insieme alla tessera sanitaria
