Personal Data
Under the General Data Protection Regulation (GDPR), all information that identifies or can identify you is subject to special protection. This includes your personal data, such as:
- phone number
- e‑mail address
- home address
- IP address
- photographs
- information related to your case and any attached documents
This information can be processed only when authorised by law or when the data subject has given valid consent, in accordance with Article 4(1) GDPR.
Information revealing your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade‑union membership, as well as data concerning your health, sex life or sexual orientation are sensitive data. Processing such information requires your explicit consent, in accordance with Article 9 GDPR.
How we process your data
When you submit an information request or a complaint, the data you provide are transferred into the European Commission’s data‑processing system, ECC‑Net 2, which is used by all European Consumer Centres. This transfer is carried out through an external service provider located in the Netherlands. As part of this process, a temporary backup of the submitted data is created to ensure that no information is lost in case of a technical error during the automatic upload. These backups are stored exclusively on servers in the Netherlands and are automatically deleted within 14 days.
We store and process your data on the basis of Article 6(1)(b) GDPR, as this is necessary to respond to your inquiry or handle your complaint. Your data are protected against unauthorised access through access controls, passwords, firewalls and other security measures. In line with the principle of data minimisation, access to your data is granted only to the responsibles for managing your case.
If you submit an information request to the European Consumer Centre Italy, your data are stored in the European Commission’s IT‑Tool ECC‑Net 2. The legal basis for this processing is Article 6(1)(b) GDPR, as the use of this system is necessary to handle your request effectively and to perform statistical evaluations.
Through ECC‑Net 2, we may also forward your request to another European Consumer Centre when their expertise is needed. Before doing so, we ask for your consent. The legal basis for such transfers is Article 6(1)(a) GDPR. Information on how your data are processed within ECC‑Net 2 is available in the European Commission’s privacy statement for this tool.
If your complaint concerns a company based in another EU Member State, Iceland or Norway, we forward your data to the European Consumer Centre in that country. The centre will use your data to analyse your complaint and contact the trader with the aim of reaching an amicable solution. Your data will also be stored in ECC‑Net 2, which is necessary for cross‑border cooperation and communication.Â
European Consumer Centres in Denmark, Finland, Norway and Sweden are legally required, under their respective national laws, to make certain complaint‑related information accessible to the public upon request. This obligation applies to any data shared with such ECCs.
In some cases, it may be beneficial for you that we forward your complaint to a European alternative dispute resolution body established under Directive 2013/11/EU, or to another qualified out‑of‑court dispute resolution body. It may also be advantageous to forward your case to a European enforcement authority responsible for applying EU consumer‑protection rules under Regulation (EU) 2017/2394.
Data storage period
We retain your personal data for no longer than three years after providing the final response to your inquiry or after the closure of your complaint procedure. This retention period is based on Article 6(1)(f) GDPR, as we have a legitimate interest in keeping the data for a limited time. Maintaining this information allows us to document the assistance provided and to ensure that we can address any subsequent issues for as long as potential claims are not time‑barred.
